Plan Payments
Can I make plan payments in person, or mail them to the office address?
No. Plan payments must be mailed to the lockbox address found on the home page.
Is there anything I need to include with my bankruptcy plan payment?
You need to make sure your bankruptcy case number and last name is written clearly ON your payment.
Can I mail a personal check?
No. If you mail a personal check to the lockbox address, it will be returned and you may be considered delinquent.
I will not be able to pay my plan payments this month. What should I do?
Contact your attorney immediately.
Delinquency
I’m late with plan payments. Can I make them up at the end or make a payment arrangement?
Contact your attorney if you become late with your plan payments. Your attorney may propose a payment arrangement for approval by the court.
I received a Trustee’s Motion to dismiss my case for delinquency. What does that mean?
Your case could be dismissed if you do not become current on your plan payments. Contact your attorney for assistance.
Trustee’s Motion To Dismiss
I received a Trustee's Motion to Dismiss (TMTD) for my case due to feasibility. What does this mean?
This means that while you may (or may not) be making your bankruptcy plan payments, the balance of your plan will not pay out prior to the end of your plan. For further questions, please consult with your attorney.
I received a Trustee's Motion to Dismiss for my case due to "missing tax returns." What does this mean?
You are required to submit copies of your tax return transcript to the Trustee each year that you are in bankruptcy. Please refer to your confirmation order and contact your attorney to ensure tax returns are timely filed and submitted properly.
I received a Trustee's Motion to Dismiss for my case, but I am current on my bankruptcy plan payments and have submitted all of my tax returns. What can I do?
Please consult with your attorney. The Trustee and her staff are prohibited from providing debtors with legal advice.
Disbursements
When does the Trustee mail disbursement checks?
Checks are mailed monthly.
Can I pick up my check in person?
No. All disbursement checks and debtor refunds are mailed.
Tax Refunds
What am I required to do on receipt of my tax refund each year?
Tax refunds must be immediately submitted to the Trustee, in full, either as an electronic payment via TFS or in certified funds to the Trustee’s bank. These payments must note the case name and case number and be mailed to PO Box 298, Memphis, TN 38101-0298. Please also send your attorney a copy of the signed tax return or a tax transcript, to be submitted to the Trustee.
Claims
How are creditors paid?
The plan payments you send the Trustee are used to pay your creditors, as well as your attorney and the Trustee.
I’m a creditor, and want to file a claim. Where do I get the form and what do I do with it?
Check the court’s website for the current form for proofs of claim. The 341 Notice you received provides the deadline and filing information.
I am a creditor and my address has changed. What do I do?
A Notice must be filed in the case and electronically served on the Trustee.
I am a creditor and want to see the disbursements that have been made on my claim. Where can I find that?
Please complete the agreement for access to the Trustee’s website on www.13network.com. Creditor access is limited to cases with claims or notices of appearance on file. Creditor attorney access is limited to cases that the attorney represents. (Email the completed and signed agreement to inquiries@ch13austin.com.)
Miscellaneous
I need to buy a car. What should I do?
You will need approval of either the Trustee or the Court. Contact your attorney for assistance.
Where can I find my Bankruptcy case number?
You can find your Bankruptcy case number on all documentation sent from the Bankruptcy court and the Trustee. The case number is written in the following format: “00-12345.”
I am a Debtor and want to see the plan payments I have made, and see what my creditors have been paid. Where can I find this information?

I am a creditor or the Debtor’s attorney. Where can I find information regarding a bankruptcy case?

I want to pay off my plan early. What do I do?
An early payoff requires that all claims be paid in full. Please contact your attorney so the attorney may verify the balance of all claims filed in your case.
What if my address has changed?
Please contact your attorney so the appropriate notice may be filed with the Court.
What if my employer has changed?
Your attorney will need to file the appropriate documents so that your plan payments are timely made.
